These Terms of Service (“Terms”) govern your use of the `Koala Learning – Learn Chinese` mobile application (the “App”), provided by `Keiko-Lab` (“we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Parental Use
The App is intended for family and educational use. It is designed primarily for children under the supervision of a parent, guardian, teacher, or other authorized adult, but it may also be used by parents, guardians, teachers, and adult learners. If you are a parent or guardian, you are responsible for:

  • supervising a child’s use of the App
  • decisions about enabling subscriptions, notifications, or iCloud sync
  • any information entered into the App, including child profile names

2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial family or educational use on Apple-branded devices you own or control, in accordance with Apple’s usage rules. We reserve all rights not expressly granted.

3. App Features
The App provides educational games and learning tools related to Chinese characters, vocabulary, pronunciation, and related progress tracking. Some features may be free, while others may require an active subscription.

4. Subscriptions and Billing
The App may offer auto-renewable subscriptions, including monthly and annual premium plans. 

If you purchase a subscription:

  • payment is charged through your Apple account
  • subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
  • your Apple account may be charged for renewal within 24 hours before the end of the current billing period
  • subscription pricing may vary by country, currency, promotional offer, and App Store storefront
  • you can manage or cancel subscriptions in your Apple account settings.

If a free trial or introductory offer is made available, any unused portion may be forfeited when you purchase a subscription, where permitted by law and by Apple’s rules.

5. Restore Purchases
If you previously purchased an eligible subscription through the same Apple account, you may use the App’s restore purchases feature or Apple’s systems to restore access, subject to Apple verification and the subscription remaining active.

6. No Unlawful or Misuse Conduct
You agree not to:

  • misuse the App or interfere with its operation
  • attempt to reverse engineer, decompile, or extract source code except where prohibited by applicable law from restricting that right
  • use the App in a way that violates applicable law or the rights of others
  • bypass parental gate or purchase protections

7. Apple Services
Certain App features may rely on Apple services, including App Store billing, notifications, and iCloud/CloudKit. Those services are controlled by Apple and may be subject to separate Apple terms, availability limits, and privacy practices. We are not responsible for outages, restrictions, or changes in Apple services.

8. Educational Purpose Only
The App is provided for educational and entertainment purposes only. We do not guarantee specific learning outcomes, fluency, academic performance, or uninterrupted access.

9. Intellectual Property
The App, including its software, text, graphics, illustrations, interface design, audio arrangements, trademarks, and other content, is owned by us or our licensors and is protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from the App except as expressly permitted by law or with our prior written permission.

10. Privacy
Your use of the App is also governed by our Privacy Policy.

11. Availability and Changes
We may update, modify, suspend, or discontinue all or part of the App at any time, including adding, removing, or changing features, content, or pricing. We are not liable if any part of the App is unavailable at any time.

12. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components.

13. Limitation of Liability
To the maximum extent permitted by law, `Keiko-Lab` and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, revenue, profits, or goodwill arising out of or related to your use of the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid, if any, for the App or subscription during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Termination
These Terms remain in effect until terminated. We may suspend or terminate access to the App if you materially violate these Terms. You may stop using the App at any time by discontinuing use and uninstalling it. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and dispute-related provisions.

15. Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law rules, except to the extent superseded by mandatory consumer protection laws in your place of residence. You submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

16. Mobile App Terms (Apple App Store)

If you access or use our mobile application downloaded from the Apple App Store, your use of the app is also subject to Apple’s Standard Licensed Application End User License Agreement (EULA).

In the event of any conflict between these Terms and Apple’s EULA, Apple’s EULA shall govern with respect to the mobile application.
